These Terms and Conditions govern your use of the YARDWAVE platform, operated by YARDWAVE ("we", "us", "our"). By creating an account or subscribing, you agree to these terms in full. If you do not agree, do not use the platform.

1. About YARDWAVE

YARDWAVE is a mood-first private music subscription platform. We provide curated music organised into seven mood categories for subscriber streaming. The platform is operated from Norway and Jamaica.

2. Subscription Terms

Plans and Pricing

YARDWAVE offers two subscription plans:

  • Monthly Plan: US$3.99 per month, billed monthly
  • Yearly Plan: US$35.00 per year, billed annually

All prices are in United States Dollars (USD). Applicable taxes may apply depending on your location.

Billing

Subscriptions are billed in advance on a recurring basis. Payment is processed through Stripe, a third-party payment processor. Your subscription automatically renews at the end of each billing period unless cancelled.

Free Browsing

You may create an account and browse mood stations and track listings without a paid subscription. Audio streaming requires an active subscription.

3. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through the billing portal accessible from your account. Upon cancellation:

  • Your access continues until the end of the current billing period
  • No further charges will be made
  • Your account remains active but reverts to free browsing access

Refund Policy

Due to the nature of digital content services, refunds are generally not provided for partial billing periods. However:

  • If you are charged in error, contact us and we will issue a full refund
  • If the platform experiences extended downtime (more than 72 consecutive hours), affected subscribers will receive a pro-rated credit
  • Refund requests within 48 hours of initial subscription may be considered on a case-by-case basis

4. Music Content and Licensing

Content Ownership

All music on YARDWAVE is created by the platform operator using Suno AI under a confirmed commercial license. 100% of rights to the finished tracks are retained by the operator. Tracks are quality-validated, professionally tagged, and curated through the YARDWAVE production pipeline before release.

YARDWAVE tracks are registered with TONO (the Norwegian performance rights organisation) for royalty management and copyright protection.

AI-Generated Content Disclosure

YARDWAVE uses Suno AI in its music production pipeline. All tracks are produced under Suno's confirmed commercial license, which grants the operator full commercial rights to the finished audio output. Each track carries embedded metadata confirming: "Suno commercial license confirmed". The final tracks are processed at studio quality (WAV 24-bit 48 kHz), mood-classified, and curated by the operator before release.

Subscriber Listening Rights

Your subscription grants you a personal, non-transferable, non-exclusive license to stream music through the YARDWAVE platform for personal, non-commercial use only.

Download and share features are provided for personal use within Jamaica and the Caribbean region. You may not:

  • Use downloaded tracks in commercial projects, videos, broadcasts, or other commercial content without a separate sync license
  • Redistribute or resell downloaded tracks
  • Upload platform tracks to other streaming services
  • Share your account credentials with others
  • Use automated tools to access or scrape platform content
  • Strip or modify embedded ownership metadata from downloaded files

Commercial redistribution of downloaded tracks is prohibited.

Creator and Broadcast Licenses

Additional licensing tiers (Creator, Broadcast, Professional) for content use, synchronisation, and commercial applications may be made available separately. Standard subscriptions do not include these rights.

5. Lyrics and Text Content

Lyrics, descriptions, and written content on the platform are owned by YARDWAVE. Some content incorporates Jamaican Patois and Caribbean English as part of the platform's cultural identity. This content may not be reproduced without permission.

6. User Conduct

By using YARDWAVE, you agree to:

  • Provide accurate information when creating your account
  • Use the platform only for lawful purposes
  • Not attempt to circumvent subscription requirements or access controls
  • Not interfere with the platform's operation or other users' experience
  • Not reverse engineer, decompile, or attempt to extract the source code of the platform
  • Maintain the confidentiality of your account credentials

We reserve the right to suspend or terminate accounts that violate these terms without prior notice or refund.

7. Account Termination

You may request account deletion at any time through the settings page. Upon deletion:

  • Your personal data will be removed within 30 days
  • Your subscription will be cancelled immediately
  • Anonymised usage data may be retained for analytics purposes

We may terminate or suspend your account immediately if you breach these terms.

8. Intellectual Property

The YARDWAVE name, logo, visual design, mood classification system, and all associated branding are the intellectual property of YARDWAVE. The platform's design, code, and structure are protected by copyright.

9. Limitation of Liability

YARDWAVE is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted access to the platform. To the maximum extent permitted by law:

  • Our total liability to you shall not exceed the amount paid by you in the 12 months preceding any claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for any loss resulting from unauthorised access to your account

10. Privacy

Your use of YARDWAVE is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

11. GDPR Compliance

For subscribers in Norway and the European Economic Area, we comply with the General Data Protection Regulation (GDPR). You have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data
  • Request portability of your data
  • Object to certain types of data processing
  • Withdraw consent where processing is based on consent

To exercise these rights, submit a request through the settings page of your account.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email to active subscribers at least 14 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by and construed in accordance with the laws of Norway for subscribers located in the EEA, and the laws of Jamaica for subscribers located outside the EEA. Any disputes shall be submitted to the exclusive jurisdiction of the courts of the applicable governing jurisdiction.
